4. Account Registration and Responsibilities

4.1 Account Creation

To access our Services, you must:

• Maintain and update your account information
• Be responsible for all activities under your account
• Maintain the confidentiality of your login credentials

4.2 Authorized Use

You represent and warrant that:

• You are responsible for ensuring training data is accurate and appropriate
• Custom configurations may be subject to additional fees

11. Third-Party Integrations

Our Services may integrate with third-party platforms and services. Your use of such integrations is subject to the terms and policies of those third parties.

11.2 API Usage

If you use our APIs, you agree to:

• Comply with our API documentation and usage guidelines

12. Limitation of Liability

12.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURPLEBERRY TECHNOLOGIES LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

13. Indemnification

You agree to indemnify and hold harmless Purpleberry Technologies LLP, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your breach of applicable laws or regulations

14. Termination

14.1 Termination by You

You may terminate your account at any time by providing written notice as specified in your service agreement.

14.2 Termination by Us

We may terminate or suspend your access to the Services immediately if you:

• Fail to pay applicable fees
• Engage in prohibited activities

14.3 Effect of Termination

Upon termination:

• Your right to use the Services ceases immediately
• We may delete your account and data after a reasonable notice period
• Accrued fees remain payable

15. Force Majeure

Neither party shall be liable for any failure to perform obligations under these Terms if performance is prevented or delayed by circumstances beyond their reasonable control, including but not limited to acts of God, government actions, natural disasters, or technical failures.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Raisinghnagar, India.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through:

Continued use of the Services after notification constitutes acceptance of the modified Terms.

18. Severability
